Yellowstone County Montana, NYC, Aurora Colorado, Lebanon Missouri: There were Criminals on the Same Wavelength Committing the Heinous Crime Upon Female Minors, Are the Punishments for the Crime on the Same Page?

Posted by HCN on Friday, September 13, 2013
Summarizing, this article is a quickly comprised look at 4 cases that have hit news headlines in recent months that regard unspeakable crimes carried out by older, physically capable males, upon contrasted lesser advantaged female teenagers and minors.

The 4 general locations of the crimes:
  • Yellowstone County, Montana
  • New York City
  • Aurora, Colorado [nearby large city: Denver]
  • Lebanon, Missouri [nearby large city: Kansas City]

Overview of cases:
  • Yellowstone County, Montana: minor was victim of teacher; recent developments include Judge Baugh attempted to rehear and give longer sentence, which was blocked, Supreme Court of Montana handling
  • New York City: teacher assault on minor of age 10 in or near June 2013
  • Aurora, Colorado [nearby large city: Denver]: Man assaults 3 females that were sisters
  • Lebanon, Missouri [nearby large city: Kansas City]: At least 3 defendants as of today, have become involved in the case

Comments:
  • The mercy of the Lord is placed upon whom the Lord willith to place.
  • Pushing too much for heftier penalties without being directly involved, therewith, might not always be appropriate.
  • It is understood that even adults that seem to have the upperhand over their victims, might not always be mentally gifted, and can be manipulated by minors; however, the weight of that, is minimal, if ever to be taken into consideration.
  • When death is involved, such as the victim commits suicide, the fullest extent of the law, when it comes to punishment of the offender, presents as viable position to take, in many assault cases.
  • In each location, treatment of the case can be compared to the other cases.
  • The sense of community togertherness could have different dynamics depending on the location, whereas stricter or less strict penalties might affect the the fabric of the society.
  • The 9 rules of what constitutes child abuse.
  • Patterns of assault, between the offender and the victim.
  • The method of luring the victim, getting to know the victim, taking advantage of the emotional maturity vulnerabilities of the victim, then carrying out crimes, which in some cases, was not a one-time isolated incident, but had marked incidents in a series of incidents over prolonged lengths of time.
  • The trend of the crime, and the importance of uprooting these trends.

Montana high court blocks hearing to review rapist's 30-day jail sentence
From Kyung Lah, CNN
updated 11:17 PM EDT, Fri September 6, 2013

(CNN) -- Saying outrage over his sentencing of a rapist to 30 days in jail could have been avoided "if I'd been more alert or if the state had pointed out" his error, a Montana judge confirmed that a higher court barred him from revisiting the sentence on Friday.

As part of that same decision, the state Supreme Court ruled that Judge G. Todd Baugh couldn't hold a hearing he had scheduled to reconsider the sentence.

Baugh had planned to reconsider the punishment after outrage over his initial sentence of a teacher who admitted raping a 14-year-old student. He explained Friday that he now understands that the conviction carried a minimum of 2 years in jail -- not 30 days -- and called Friday's hearing to address his mistake.

The high court order came shortly before this hearing on Friday, the judge said. After it did, Baugh said that he signed paperwork that -- over his objections -- sends the case on to the higher court.

"The appeal process will proceed forward, the Supreme Court will review the matter, and they will issue whatever orders they think are appropriate at that point in time," Baugh explained as to what will happen now.

In a strange twist to an already odd case, the defense and prosecution agreed that Friday's hearing should be called off -- albeit for very different reasons. Both sides questioned whether revisiting the sentence was even legal, with the defense saying nothing should change and prosecutors saying changing it could hurt their appeal.

They got what they wanted when the state high court vacated the hearing.

New hearing in Montana rape case

"We conclude that the stated intent of the District Court to alter the initially imposed oral sentence in today's scheduled hearing is unlawful and that the proceeding should be arrested," the court said. "We take no position on the legality of the imposed sentence and will address the parties' arguments in that regard on appeal."

Noting his office appealed to the state Supreme Court on Wednesday, Montana Attorney General Tim Fox cheered Friday's decision and the fact prosecutors "are moving forward with (the) process."

"The only way to ensure the rule of law prevails and justice is ultimately served is for my office to appeal the sentence," Fox said in a statement.

The defense, meanwhile, believes the sentence earlier announced in court by Baugh -- with all but 30 days suspended -- should stand.

In a response filed Thursday with the Yellowstone County Court, defense attorney Jay Lansing joined prosecutors in saying that the new hearing would be "without legal authority."

The case drew widespread attention when Baugh imposed the 30-day sentence on Stacey Dean Rambold and made controversial comments about the victim, saying she "seemed older than her chronological age."

Rambold admitted raping the girl while he was her teacher at her high school. Cherice Moralez took her life shortly before her 17th birthday.

In an order this week, the judge said it appears the mandatory minimum is two years, not 30 days. He said the court, "if necessary and appropriate," would amend the sentence at Friday's hearing.

Such a hearing, however, would "create confusion and uncertainty for all parties left to interpret and execute the sentence of Mr. Rambold," Lansing argued.

He said his client contends the sentence imposed, which prosecutors are appealing, is lawful and appropriate.

Prosecutors filed an emergency petition Thursday with the Montana Supreme Court, asking it to stop the scheduled hearing.

While acknowledging "the district court's effort to correct the error at the trial court level," they wrote that the "only remedy prescribed by statute and case law is appeal before this court.

"Further, the September 6 hearing, if permitted to be conducted, will undermine the State's appeal and otherwise frustrate the just and orderly administration of ordinary appeal processes," the petition read.

In Montana, a case study in rape culture
By Lyn Mikel Brown, Special to CNN
updated 7:43 PM EDT, Tue September 10, 2013

Editor's note: Lyn Mikel Brown, Ed.D., is a professor of education at Colby College. She is the author of "Packaging Girlhood" and co-founder of SPARK Movement, an intergenerational activist campaign challenging the sexualization of girls, andHardy Girls Healthy Women, a nonprofit organization based in Waterville, Me. and dedicated to the health and well being of girls and women.

(CNN) -- Recently in my hometown, a 44-year-old male teacher was arrested for unlawful touching of a minor and possessing child pornography.

A 12-year-old told and someone believed her. Thousands of pornographic pictures of children were found on his laptop, according to the County District Attorney. (The accused "denies any wrongdoing of any kind," his lawyer said, and lawyers on both sides said the charges did not involve students.)

Whatever the outcome of this case, I fear for this child. Someone believed 14-year-old Cherice Moralez of Billings Montana, too, when she accused her 49-year-old teacher, Sandy Rambold, of forcible rape. He confessed, faced charges and then should have received a sentence commensurate with the crime of rape.

But the legal process played out over three years, and just before her 17th birthday, Moralez, shamed and shunned by classmates, shot herself. District Judge G. Todd Baugh sentenced Rambold to just 30 days. (The public outrage that followed caused Baugh to attempt a review of his own sentencing, a move the Montana State Supreme Court denied last week.)

"He'd suffered enough," Baugh said of Rambold at the initial sentencing, and besides, Moralez, "older than her chronological age," was "as much in control of the situation" as her teacher, he said. "Obviously a 14-year-old can't consent," the judge explained in the wake of public outrage, but this wasn't "some violent, forcible, horrible rape." It wasn't, said the judge, "this forcible beat-up rape."

Where does this bizarre line of reasoning come from? We need only look around for clues at a media culture that regularly tells young girls that growing up means shedding all signs of pink princess innocence for a porn version of sexy. A culture that celebrates Robin Thicke singing, "I know you want it" at the VMAs as Miley Cyrus -- having made the lightening quick transformation from teen role model to sex object, whose job it is to give pleasure to a grown man-- twerks in his crotch.

We reward girls and young women who take off their clothes, tell them that their sexual availability and sexual power are their most important assets. We grant them record deals, reality TV shows, and global news coverage. Once they cross over, slut-shaming and Judge Baugh-like sentences enable men like Rambold to take full advantage -- as long as it's not "this forcible beat-up rape."

Judge wants do over on rape sentence
New protests over 30-day rape sentence

We rarely hear from young women themselves about what it's like to traverse this cultural terrain. So I asked members of the SPARKteam (girl activists ages 13-22 from SPARK Movement) to talk about what happened to Cherice. What does it feel like to be 14 and want to be wanted, to experience this new kind of power and illusion of control?

Erin, 18, says she immediately identified with Cherice, because "I was her. I remember being 14 and talking to 30 year-olds on the Internet. I was feeling really alone and struggling to come to terms with who I was. I wanted to have some kind of social (and sexual) connection with people. That's what led me to leer in chat rooms and talk to men who were more than twice my age. Maybe they would love me and maybe I could feel less insecure."

Erin knows firsthand how easy it is "to get caught up in your undying feelings for someone, especially someone who is manipulating you into loving them. At 14, you think that you know everything -- you think this person isn't doing anything wrong by having a relationship with you, and that no one understands. He becomes your world. You think that you're in love, when what you're really in is abuse."

"When you're 14," 15-year-old Luci says. "It seems like the rest of the world is against you, especially if, as the judge described Morales, you're 'a troubled kid.' I can get that, and I can see why Cherice found refuge in a relationship with her teacher. When I was her age, there was this one teacher who everyone at my school adored. He saw potential in me that I was too insecure to see in myself. I looked like I could be in college. He treated me like I was grown up, so I thought I was more mature than I really was. But that's the thing: Looking older than you are in no way equals being emotionally mature."

Celeste, 20, implicates Judge Baugh's unquestioned participation "in a culture where representations of Latinas prioritize sex appeal. Baugh's claims speak volumes about the way women of color are hypersexualized. Cherice was only 14, but when Baugh looked at her he saw someone older who was therefore experienced enough to understand, and even control, a sexual situation. She did not fit his image of 'youth' and 'purity,' so this 70-year-old Judge did not see a young girl who was victimized, but a sexually viable woman."

Because the lines are blurred, we need judges who are educated and aware enough to see through the subterfuge of sexism and racism, who do the right thing -- whether in Steubenville, Billings, or my hometown. Whatever else is going on in girls' lives, whatever media messages we all receive about the commodification of their sexuality, we need to send a clear message that rape and sexual assault are crimes for a reason, that justice has nothing to do with how mature a girl looks or acts and everything to do with her suffering and her right to human dignity.

An Aurora man was convicted of sexually abusing three young Aurora girls after his victims spoke up about their years of abuse.

Rodolfo Cendejas, 48, was convicted Monday of 15 counts of sexual assault on a child — pattern of abuse and 17 additional related charges based on his abuse of the girls, according to a news release from Colorado's 18th Judicial District Attorney's Office.

The abuse began when the oldest sister was 13 years old, according to the release. She resisted Cendejas, so he turned to her 9-year-old sister, whom he abused for more than a year.

When she began to resist, he turned to the youngest sister, then 10 years old, and sexually assaulted her for the next two years, until she sought help in May 2012.

Cendejas fully confessed to assaulting the youngest sister for two years, confessed only to fondling the second victim and denied assault of the eldest sister, according to the release.

"I am sickened that this so-called man, Rodolfo Cendejas, destroyed three little girls' childhoods," District Attorney George Brauchler said in the release. "They were very brave."

Cendejas faces eight to 540 years in prison, according to the release. Sentencing is scheduled for October.

Three more defendants sentenced in sadomasochistic sex trafficking conspiracy

WARNING:  This story is sexually graphic.

Updated September 12, 2013 - NEWS RELEASE ISSUED BY THE OFFICE OF THE U.S. ATTORNEY WESTERN DISTRICT OF MISSOURI

HUMAN TRAFFICKING RESCUE PROJECT

THREE MORE DEFENDANTS SENTENCED IN SADOMASOCHISTIC
SEX TRAFFICKING CONSPIRACY

KANSAS CITY, Mo. – Tammy Dickinson, United States Attorney for the Western District of Missouri, announced that three more defendants were sentenced in federal court today for their roles in the sex trafficking of a young woman who was coerced into being a sex slave for several years while she was tortured in a trailer home located in a wooded area in Lebanon.

Michael Stokes, also known as "The Rodent," 65, of Lebanon, Mo., and James Noel, 47, of Springfield, Mo., were each sentenced to five years in federal prison without parole in separate hearings before U.S. District Judge Dean Whipple. Marilyn Bagley, 48, of Lebanon, was sentenced to five years of probation.

The court also ordered that $738,250 in total restitution must be paid to the victim. Each defendant is individually liable for $123,041, or one-sixth of the total amount.

On Dec. 6, 2012, Marilyn Bagley pleaded guilty to her role in the conspiracy to commit sex trafficking by force, fraud or coercion. Marilyn Bagley admittedly knew that other individuals came to the residence to engage in sexual conduct and sadistic acts on the female victim (identified in court documents as FV). Over a six-year period, FV endured sadistic acts of torture, many of which were photographed and videotaped. FV would be punished if she did not do as instructed. Several individuals provided bondage pornography, meat, cigarettes, and cash, among other items, in exchange for the sessions involving sexual conduct and sadistic acts on FV.

The government stated in court at the time of her guilty plea that Marilyn Bagley is considered in a separate category from the other defendants in this case because she was a victim of extensive physical and emotional abuse by her husband, co-defendant Edward Bagley, Sr., also known as "Master Ed," 46, for over 25 years prior to her criminal conduct and participation in the conspiracy. Her participation in the criminal conduct resulted in the abuse being redirected away from her and to the victim.

Stokes pleaded guilty on Jan. 5, 2012, to participating in the sex trafficking conspiracy. Stokes became familiar with FV in 2006 when he received pictures of her over the Internet in which she was naked with whip marks over her body. Stokes was told that the victim was a slave for "life" who was tortured for hours at a time and was required to do "everything and anything" she was told. After a few weeks of chatting online, Edward Bagley brought the victim to Stokes' house so she could do a "demo" for him. When they arrived at Stokes' residence, bringing a duffle bag of torture devices with them, FV was instructed to "put on a show for us." FV was naked [...---content referencing obscenity deleted---]. Stokes was asked whether he wanted to have sex with her. Stokes said "yes" and he had sex with FV.

Stokes was stunned that "someone had that much control over someone" and "had never seen anything like it."

Stokes began visiting the Bagley residence where FV was being held. During his first visit, he was shown a photo of [a physical act of harm done upon the body using medically related techniques...---content referencing obscenity deleted---] and told this was done to demonstrate "what was expected of her." FV was present for these statements and remained silent. FV never talked back or spoke up. FV never offered herself to Stokes and only acted on command.

Stokes visited the Bagley residence eight to 12 times. During these visits, he would receive sexual acts or be allowed to watch or participate in torturing FV. When he visited he brought steaks, hamburgers, jackets, personalized playing cards, lighters, cigarettes, and cash. Among other things, he witnessed FV being tortured with a [...---content referencing obscenity deleted---].

Stokes helped promote FV at the strip clubs. Stokes took photos of FV around to the clubs to promote her there.  Stokes gave $1,000 so that FV could be taken for a sexual bondage photo shoot in California for Taboo magazine. Stokes then took a copy of the magazine to promote her at the clubs. The photos in Taboo magazine were extremely mild and did not depict any of the cruel sessions Stokes had witnessed at the residence.

In 2009, Stokes was warned that there was an FBI investigation involving his conduct with FV. Stokes went on his computer and deleted hundreds of photos, his contacts with other females online, pictures of FV that he saved, and destroyed his copies of Taboo magazine and the sexual devices that he had acquired.

Noel pleaded guilty on Feb. 24, 2011, to participating in the sex trafficking conspiracy. Noel admitted that he was one of the customers who sexually abused and tortured FV. Noel watched the victim being tortured and sometimes operated torture devices himself beginning in 2006, when she was approximately 20 years old. For example, Noel knew that FV hated being [...---content referencing obscenity deleted---], which he described as extremely painful, but he used it on her anyway.

Three defendants in this case were sentenced on Wednesday, Sept. 11, 2013.

Edward Bagley and Bradley Cook, also known as APutHer2GoodUse, 34, of Kirkwood, Mo., were each sentenced to 20 years in federal prison without parole. Dennis Henry, 53, of Wheatland, Mo., was sentenced to 10 years in federal prison without parole. As part of the agreement obtained by the government, Cook was required to pay $123,041 in restitution at the time of his sentencing. Edward Bagley and Henry are individually liable for $123,041 in restitution. Their wages will be garnished while in custody, and after they are released, until they have paid their restitution in full.

Following their prison terms, Bagley, Cook and Henry will be on supervised release for the rest of their lives. Among the terms of supervision ordered by the court, they must adhere to a 10:30 p.m. curfew and are prohibited from any contact with the victim, the government's attorneys and the agents involved in the case.

This case marked the first time nationwide that the customers, or "Johns," have been convicted under the Trafficking Victims Protection Act in a sex trafficking case in which the victim was an adult. This is also the first human trafficking conviction in which the customers were prosecuted in a case that involved an actual victim rather than an undercover sting operation.

On Jan. 15, 2013, Bagley pleaded guilty to enticing a minor into illegal sexual conduct and prostitution. Bagley met FV in 2002, when she was 16 years old and dating his teenage son. FV visited his trailer residence in Lebanon on numerous occasions. During FV's visits to Bagley's residence, he showed her images and videos of pornography on the Internet and downloaded from the Internet, including images and videos of bondage and sadomasochistic conduct. Bagley admitted that he provided FV with controlled substances. He taught her about bondage and sadomasochistic activities. His wife, co-defendant Marilyn Bagley, 48, modeled stripper and bondage clothing for FV. The Bagleys told FV that she would love being a "slave" for him. Bagley began a sexual relationship with FV prior to her seventeenth birthday.

FV viewed Edward Bagley as her boyfriend and moved into the Bagleys' residence in 2003. They provided FV her own room and clothes, and promised her a great life.

Over the course of the next six years, Edward Bagley executed sadistic acts of torture on FV, including [...---content referencing obscenity deleted---]. Edward Bagley photographed and videotaped many of the acts he performed on her. FV would be punished if she did not do as instructed.

Cook pleaded guilty on Dec. 20, 2011, to participating in a conspiracy to commit sex trafficking by force, fraud or coercion. From 2006 to 2009, Cook watched the victim being sexually abused and tortured in live online sessions and as depicted in photos and videos that he downloaded from the Internet. Cook admitted that he traveled to Lebanon on multiple occasions during that time to engage in sessions of sexual acts and torture with the victim. In exchange, Cook paid the victim=s Amaster@ for these sessions with such items as computer hard drives that contained images and videos of bondage, domination, sadism and masochism, which he had downloaded from the Internet.

Cook also admitted he was aware of other men who engaged in sexual acts and torture with the victim. He witnessed the victim being whipped and locked in a dog cage, as well as being tied up and shocked with multiple electrical devices. Cook described the abuse suffered by the victim as the most extreme he had ever seen.

Henry, formerly the postmaster of Nevada, Mo., pleaded guilty on March 24, 2011, to participating in the conspiracy. Henry also pleaded guilty to transporting the victim across state lines for sexual activity.

Henry admitted that he engaged in sex with the victim, and participated in torture sessions with FV that would last for hours. Henry saw pictures of FV=s vagina sewn shut, which he was told was a form of punishment. Henry also admitted that he visited FV at a Lebanon strip club where she was forced to work.

This case was prosecuted by Assistant U.S. Attorneys Cynthia L. Cordes, Paul Becker and John Cowles with assistance from the Department of Justice Civil Rights Division's Human Trafficking Prosecution Unit. It was investigated by the FBI in conjunction with the Human Trafficking Rescue Project.

LEBANON MAN SENTENCED TO 20 YEARS FOR COERCING A MINOR TO BECOME A SEX SLAVE; TWO CUSTOMERS ALSO SENTENCED FOR SEX TRAFFICKING

KANSAS CITY, Mo. – Tammy Dickinson, United States Attorney for the Western District of Missouri, announced that a Lebanon, Mo., man was sentenced in federal court today for using the Internet to groom and entice a minor girl into illegal sexual conduct that led to years of sadomasochistic abuse, and two of his customers were sentenced for their roles in the sex trafficking conspiracy.

"This courageous young woman, who confronted her tormentors in court today, is getting justice for the horrific suffering and enslavement she endured at the hands of these sexual sadists," Dickinson said. When he visited he brought steaks, hamburgers, jackets, personalized playing cards, lighters, cigarettes, and cash. Among other things, he witnessed FV being tortured with [...---content referencing obscenity deleted---].

Stokes began assisting in promoting FV at the strip clubs.

Under federal statutes, Stokes is subject to a sentence of up to five years in federal prison without parole, plus a fine up to $250,000 and an order of restitution.

Co-defendantJames Noel, 47, of Springfield, pleaded guilty on Feb. 24, 2011, to participating in the conspiracy. Noel admitted that he was one of the customers who sexually abused and tortured FV. Noel watched the victim being tortured and sometimes operated torture devices himself beginning in 2006, when she was approximately 20 years old. For example, Noel knew that FV hated being [...---content referencing obscenity deleted---], which he described as "extremely painful," but he used it on her anyway.

Under federal statutes, Noel is subject to a sentence of up to five years in federal prison without parole, plus a fine up to $250,000 and an order of restitution.

This case is being prosecuted by Assistant U.S. Attorneys Cynthia L. Cordes, PaulBecker and John Cowles with assistance from the Department of Justice Civil Rights Division's HumanTrafficking Prosecution Unit. It was investigated by the FBI in conjunction with the Human Trafficking Rescue Project.

Missouri man gets 20 years for keeping young woman as sex slave

(CNN) -- A Missouri man was sentenced on Wednesday to 20 years in federal prison for his role in the years-long sexual torture of a "mentally deficient" young woman that included electrical shock and mutilation, the U.S. Attorney's Office for the Western District of Missouri told CNN.

A federal judge accepted a plea agreement from Edward Bagley Sr., 46, in a Kansas City courtroom on Wednesday morning, the U.S. Attorney's Office said. In January, he pleaded guilty to one of the 11 counts he faced for having a sexual relationship with a minor, who was identified only by the initials "FV" (or Female Victim) in official documents. Bagley faced life imprisonment.

Bagley held the victim as a sex slave from December 2002 to February 27, 2009, in his Lebanon, Missouri, trailer home. The woman -- who was a runaway minor at the time when the abuse began -- was sometimes "hung upside down," "water [...---content referencing obscenity deleted---]" and had animals she cared for shot in front of her by Bagley to coerce her to engage in commercial sex acts, the indictment read.

"In or about December 2002, (Bagley) invited FV, a 16-year-old minor, who grew up in foster care homes, into his residence after she ran away from home and promised her 'a great life,' including, but not limited to, making her a model and a dancer, and 'making her dreams come true,'" the indictment read.

"(Bagley) advertised and publicized FV over the Internet and in live web cam sessions as his slave who would engage in sexual acts and could be tortured during live online sessions, or in person," an indictment read.

Once the victim turned 18, Bagley had "FV sign a 'sex slavery' contract" and told her the contract "legally bound her to him as his 'sex slave' with a term that 'never' ended," according to the indictment.

During the six years of abuse, Bagley also performed abortions on the victim using things like "vacuums, and clothing hangers for the purpose of terminating the pregnancies," the indictment said.

The victim was discovered by first responders after she suffered cardiac arrest during a torture session on February 27, 2009, the indictment read.

Five other defendants, including four men and Bagley's wife, Marilyn Bagley, are scheduled to be sentenced this week. The four men were alleged to have traded Bagley things like "cigarettes, computer hard drives, sadomasochism videos, coats and meats" to use the young woman as a sex slave, according to the indictment.

The U.S. Attorney's Office said that lawyers for the victim were seeking $738,250 for physical and psychological trauma to their client.
